The Chargé in Peru (Sterling) to the Secretary of State

49. As reported in my 48, May 24, 2 p.m.,9 I had an interview yesterday with the President, and this afternoon I saw the Minister of Foreign Affairs, who stated that it was decided at a meeting of the Council of Ministers and of the Diplomatic Committee of the Congress that the Government of Peru accepts the views of the Department of State. The delegates to the conference will confine themselves to the unfulfilled portions of the treaty and will not be instructed to present the claim that the treaty has been nullified, but are to contend that article 3 has been violated and cannot now be fulfilled. It would seem from our conversation that the Minister expects disagreement with Chile over this article to precipitate arbitration and that all claims that Chile has violated the treaty will thereupon be brought up.
