951. Re urtel 1584, May 25. Confirming telephone conversation with Hyde,1 Dept agrees with your helpful analysis of situations which may arise in SC on Chinese representation issue under Malik’s presidency.

We assume challenge of Malik’s ruling in Para 2(B) of urtel wld be on ground that president has no power to make such ruling particularly in light of rule 17 of SC Rules of Procedure.

We understand you will discuss in detail possible procedural situations with friendly Dels and on basis of results will inform Dept whether approach to capitals advisable.2
