Memorandum by the Chief of the Division of the American Republics (Duggan) to the Legal Adviser (Hackworth)

Mr. Hackworth: In the case of the recent change of government in Brazil, before President Vargas term of office expired the Constitution was abrogated and a new Constitution proclaimed which continues him in office subject to a plebiscite at some as yet undetermined date. Inasmuch as the Department may be confronted with similar situations in other countries I would appreciate your comment with regard to the question as to whether or not the need for recognition arises under the above circumstances.
